: This paper considers whether a physician is criminally liable for administering a dose of painkillers that hastens a patient's death. The common wisdom is that a version of the doctrine of double effect legally protects the physician. That is, a physician is supposedly acting lawfully so long as the physician's primary purpose is to relieve suffering. This paper suggests that the criminal liability issue is more complex than that. Physician culpability can be based on recklessness, and recklessness hinges on (...) whether a physician has taken an unjustifiable risk of hastening death. The authors identify three conditions of justifiability. D'Oro's prose is lucid and tightly argued: her analyses of the problems that concerned Collingwood, as well as her reinterpretations and supporting arguments, are a thoughtful model of clarity.Collingwood is generally ignored except by philosophers of art and history; D'Oro aims to reassess Collingwood's important metaphysical and epistemological views and raise awareness of them. Background: The factors influencing parents’ willingness to enroll their children in biobanks are poorly understood. This study sought to assess parents’ willingness to enroll their children, and their perceived benefits, concerns, and information needs under different consent and data-sharing scenarios, and to identify factors associated with willingness. Methods: This large, experimental survey of patients at the 11 eMERGE Network sites used a disproportionate stratified sampling scheme to enrich the sample with historically underrepresented groups. Participants were randomized to receive one of (...) three consent and data-sharing scenarios. Results: In total, 90,000 surveys were mailed and 13,000 individuals responded (15.8% response rate). 5737 respondents were parents of minor children. Overall, 55% (95% confidence interval 50–59%) of parents were willing to enroll their youngest minor child in a hypothetical biobank; willingness did not differ between consent and data-sharing scenarios. Lower educational attainment, higher religiosity, lower trust, worries about privacy, and attitudes about benefits, concerns, and information needs were independently associated with less willingness to allow their child to participate. Of parents who were willing to participate themselves, 25% were not willing to allow their child to participate. Being willing to participate but not willing to allow one’s child to participate was independently associated with multiple factors, including race, lower educational attainment, lower annual household income, public health care insurance, and higher religiosity. Conclusions: Fifty-five percent of parents were willing to allow their youngest minor child to participate in a hypothetical biobank. Building trust, protecting privacy, and addressing attitudes may increase enrollment and diversity in pediatric biobanks. (shrink)

Aaron Ridley has concluded that “Collingwood’s global Idealism is really only a distraction from the much more important and interesting ideas that constitute his aesthetics.” My paper takes issue with this conclusion. Collingwood’s idealism is an integral part of his aesthetics, and it simply cannot be shucked off, leaving his aesthetics untouched and intact. A careful reading of Collingwood’s oeuvre in aesthetics reveals that it is his long-standing antipathy to realism that grounds both his critique of pseudo-art and his own (...) theory of art, particularly his idealist theory of the imagination. If Collingwood’s aesthetics are interesting and important, so is the idealism that grounds them. (shrink)

Collingwood’s An Essay on Philosophical Method provides an insightful critique of Russell’s analysis and metaphysics of logical atomism, proposing an unduly neglected neo-idealist alternative to Russell’s philosophical method. I summarize Collingwood’s critique of analysis and sympathetically outline the philosophical methodology of Collingwood’s post-Hegelian dialectical method: his scale of forms methodology, grounded on the overlap of philosophical classes. I then delineate Collingwood’s critique of the metaphysics of logical atomism, demonstrating how the scale of forms methodology is opposed to Russell’s logical atomism. (...) I argue that eliminative materialism, with its aim of jettisoning folk psychology, cannot account for the possibility of historical knowledge. Eliminative materialism destroys the disciplinary distinctions between history and science in such a way as to eclipse the former. I argue that ‘historical consciousness’ cannot be reduced to the discoveries of neuroscience; Paul Churchland’s charge of folk psychology’s explanatory impotence is undercut by the possibility, indeed, the actuality of historical knowledge, and one of Churchland’s main arguments for eliminative materialism is (...) dependent upon historical knowledge-claims that themselves must contradictorily utilize the propositional attitudes of folk psychology. Relatives of persons with severe mental illness face a straining life situation and need support. Exclusion of relatives in mental health care has long been reported. The aim of this study was to describe conceptions of nurses in mental health care about supporting relatives of persons with severe mental illness. Focus group interviews with nurses from all levels of mental health care in Norway were performed. A phenomenographic approach was used. The nurses found that their responsibility first and foremost was (...) the patient, especially to develop an alliance with him or her. Additional premises for supporting relatives were the context framing the nursing care, aspects of the actors, and relational concerns between them. Competing or contradictory demands were found within these premises. Two paths were identified concerning the nurses’ support of relatives: seeing the relative in the shadow of the patient or as an individual person. (shrink)

Background Inadequate knowledge among health care providers (HCPs) and parents of affected children limits the understanding and utility of secondary genetic findings (SFs) in under-represented populations in genomics research. SFs arise from deep DNA sequencing done for research or diagnostic purposes and may burden patients and their families despite their potential health importance. This study aims to evaluate the perspective of both groups regarding SFs and their choices in the return of results from genetic testing in the context of orofacial (...) clefts.Methods Using an online survey, we evaluated the experiences of 252 HCPs and 197 parents across participating cleft clinics in Ghana and Nigeria toward the return of SFs across several domains.Results Only 1.6% of the HCPs felt they had an expert understanding of when and how to incorporate genomic medicine into practice, while 50.0% agreed that all SFs should be returned to patients. About 95.4% of parents were willing to receive all the information from genetic testing (including SFs), while the majority cited physicians as their primary information source (64%).Conclusions Overall, parents and providers were aware that genetic testing could help in the clinical management of diseases. However, they cited a lack of knowledge about genomic medicine, uncertain clinical utility, and lack of available learning resources as barriers. The knowledge gained from this study will assist with developing guidelines and policies to guide providers on the return of SFs in sub-Saharan Africa and across the continent. (shrink)

The Ontology for Biomedical Investigations (OBI) is an ontology that provides terms with precisely defined meanings to describe all aspects of how investigations in the biological and medical domains are conducted. OBI re-uses ontologies that provide a representation of biomedical knowledge from the Open Biological and Biomedical Ontologies (OBO) project and adds the ability to describe how this knowledge was derived. We here describe the state of OBI and several applications that are using it, such as adding semantic expressivity to (...) existing databases, building data entry forms, and enabling interoperability between knowledge resources. OBI covers all phases of the investigation process, such as planning, execution and reporting. It represents information and material entities that participate in these processes, as well as roles and functions. Prior to OBI, it was not possible to use a single internally consistent resource that could be applied to multiple types of experiments for these applications. OBI has made this possible by creating terms for entities involved in biological and medical investigations and by importing parts of other biomedical ontologies such as GO, Chemical Entities of Biological Interest (ChEBI) and Phenotype Attribute and Trait Ontology (PATO) without altering their meaning. OBI is being used in a wide range of projects covering genomics, multi-omics, immunology, and catalogs of services. OBI has also spawned other ontologies (Information Artifact Ontology) and methods for importing parts of ontologies (Minimum information to reference an external ontology term (MIREOT)). The OBI project is an open cross-disciplinary collaborative effort, encompassing multiple research communities from around the globe. To date, OBI has created 2366 classes and 40 relations along with textual and formal definitions. This update provides new information about resources and documents now available while continuing to include important earlier sources.)Hospital ethics committees increasingly have taken hold in the United States since 1983, when the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research encouraged their (...) creation in its report, Deciding to Forego Life-Sustaining Treatment (III, 1983, p. 5).The President's Commission report (pp. 160-64) suggested the following roles for ethics committees: 1) review of treatment decisions made on behalf of incompetent, terminally ill patients; 2) review of medical decisions having ethical implications with the option, in cases of disagreement, to refer cases to a court with proper jurisdiction; 3) provision of social, psychological, spiritual, or other counseling for patients, family members, physicians, or other hospital staff; 4) establishing guidelines regarding treatment or other medical decisions; and 5) sponsoring or conducting educational programs to inform all concerned, including the public, about ethical problems in medicine.No exact count of these committees is available. According to estimates cited by Donald F. This book presents a similar contrast—insights into “The Wreck of the Deutschland” buried in the technical language of structuralism, semiotics, and rhetoric.In his preface, the author calls his book “a revised and updated translation of my I fogli della Sibilla. Retorica et medievalismo in Gerard Manley Hopkins” (p. ix). As the title indicates, it is divided into two parts, the former dealing with Hopkins’s poetic rhetoric viewed synchronically and the latter with his “textuality as a confluence of... cultural codes” (p. 89).In the chapter introducing part one, Marucci dismisses, with few exceptions, criticism from 1918 to the present as being of little use to one investigating “the function and functionality of Hopkins’s poetic rhetoric” (p. 3). The exemplifying portion of this chapter (“Amplification”) addresses “God’s Grandeur” and “The Wreck of the Deutschland” as judicial speech (persuasive), with the reader performing the judicial function. The analysis is useful in providing insights into the poet’s rhetorical planning as he guides the reader in this persuasive process.Moving from the “Deutschland” to the “terrible sonnets” as exemplifications of “autocommunication,” Marucci notes that here the interlocutor gradually disappears as the sender-receiver relationship fades. He believes that Hopkins became “no longer capable of finding in himself (or, more probably, of offering to a receiver who had proved cold and indifferent) the necessary stimuli” (p. 76) and names the editor of The Month, Bridges, and other correspondents as the probable receivers.In the second (and major) part of the book, the author sets out to examine the cultural codes influencing the poet’s textuality. The chapter introducing this section, “‘Integrated’ and ‘Apocalyptic’ Writers,” first looks at “the global syntagmatic model of the Victorian Age” (p. 98) and then divides its texts according to this model into three categories. The first two either reflect or modify the syntagmatic codes (“integrated” writers) while the third opposes these codes (“apocalyptic” writers). The author’s thesis is that Hopkins is not fully any one of these, but that his Victorianism is subsumed in various ways and ultimately subordinated to his medievalism. His position is that Victorian codes essentially ceased to affect the poet after his entrance into the Society of Jesus, when they were replaced by medieval codes. This is developed in some detail in the chapter entitled “Hopkins and Duns Scotus.”Although the book takes a narrow critical approach to Hopkins, it still might [End Page 149] well have been enriched by allowing for the ways in which the Ignatian method of meditation, with its emphasis on the “application of the senses,” so clearly drew Hopkins to find a kindred spirit in Scotus. She did not consider herself a philosopher because, to her, a philosopher was "someone who has built a great system" (Simons and Benjamin 1979, 338). Her book, nonetheless, became a milestone in feminist philosophy, for it synthesizes elements of existentialism, phenomenology, and socialism in an account of women's situation in society. Central to this account is Beauvoir's concentration upon representations of "self" and "other." For example, Beauvoir affirmed, "The category of the Other is as primordial as consciousness itself. In most primitive societies, in the most ancient mythologies, one finds the expression of a duality--that of the Self and the Other. This duality was not originally attached to the division of the sexes; it was not dependent upon any empirical facts" (1993, xl). In an interview, Beauvoir stressed, "I believe that the Other is not simply an idealist relationship, it is a materialist relationship" (Simons and Benjamin 1979, 345). To develop her analysis, Beauvoir drew upon another binary, "master" and "slave." However, she concentrated on how women, as a category, had been subordinated as men's "other."Twenty years ago, in 1979, Audre Lorde delivered her best-known speech, "The Master's Tools Will Never Dismantle the Master's House," at an international conference held in honor of the thirtieth anniversary of [End Page 259] Beauvoir's book. According to conference organizer Jessica Benjamin and reporter Lilly Rivlin, writing together in Ms. magazine, "[M]ore than 800 women from all over the world gathered at a conference on feminist theory, 'The Second Sex--Thirty Years Later,' sponsored by the New York Institute for the Humanities" (1980, 48). Like most of the conference participants, Lorde was a woman, a feminist, a socialist, a public intellectual, and an activist scholar. Lorde may have participated in the conference as a "consultant," a poet at a public reading, and a speaker at a plenary session 2 because her feminist philosophy is of resonance to Beauvoir's. Both women rejected biology as the basis for women's situation, believing instead that material conditions are most fundamental. Both commented upon the power of symbolism, especially myths about others, in perpetuating social inequalities and failing to differentiate categories for others. Both saw the relationship between "self" and "other" as a vital and creative tension.To understand this tension, Beauvoir drew explicitly on Hegel's ideas as they were treated in Sartre's oeuvre (Lloyd 1983). In contrast, Lorde may have drawn upon conceptions of double consciousness among black public intellectuals in the United States (Henderson 1989, 17-21). Unlike Beauvoir, Lorde was a lesbian, a mother, and a black woman for whom Beauvoir's analogies between the status of women and the status of "Negroes" were problematic. Confronting the conference participants on the last day, during the last panel entitled "The Personal and the Political," Lorde condemned the conference for its limited range of speakers, its substance, its very structure. Lorde examined the ramifications of failing to include others as equals. For in failing to do so, the conference had employed the same tools of oppression over others that the participants deplored in the politics of patriarchy. Computational models will play an important role in our understanding of human higher‐order cognition. How can a model's contribution to this goal be evaluated? This article argues that three important aspects of a model of higher‐order cognition to evaluate are (a) its ability to reason, solve problems, converse, and learn as well as people do; (b) the breadth of situations in which it can do so; and (c) the parsimony of the mechanisms it posits. This article argues that fits of (...) models to quantitative experimental data, although valuable for other reasons, do not address these criteria. Further, using analogies with other sciences, the history of cognitive science, and examples from modern‐day research programs, this article identifies five activities that have been demonstrated to play an important role in our understanding of human higher‐order cognition. These include modeling within a cognitive architecture, conducting artificial intelligence research, measuring and expanding a model's ability, finding mappings between the structure of different domains, and attempting to explain multiple phenomena within a single model. Why did the Biblical writers see the fear of the Lord as a virtue that is conducive to human flourishing? It is difficult for contemporary readers to understand how fear of anything can be virtuous. I propose that the fear of the Lord should be understood as accountability to God. I defend the claim that someone who displays excellence in an accountability relationship does display a virtue, and that this virtue is particularly valuable when exercised in relation to (...) God. If we reject an individualistic view of moral motivation inspired by Kant, we can see that being held accountable does not necessarily diminish personal autonomy. The primary motivation for the person who has the virtue of accountability is not fear of punishment, but a desire to do what is right because it is right, rooted in an appreciation of the standing of one to whom one is accountable.
